Following the UK departure from the EU on 1 January 2021 England, Scotland and Wales are no longer subject to EU regulations, however the UK retained the REACH regulation, the Classification, Labeling and Packaging regulation, the Cosmetics regulation and the Biocides regulation as well as many others. These are now being revised and all substances regulated under them need to be re-registered, authorized or approved as necessary.
The UK REACH regulation has new transitional rules and deadlines. These are only relevant to England, Scotland and Wales.
Following the UK departure from the EU it was necessary to keep trade flowing. DUIN allowed GB based companies who had legally received REACH registered substances in the two years prior to 1 January 2021 to continue to do so without a full registration until a deferred registration deadline.
GB based companies who held valid REACH registrations for substances were allowed to grandfather these registrations into the new scheme without additional fee.
Substances which were registered before 1 January 2021 are considered existing. GB based companies (and international companies using a GB Only Representative) can register these using the normal registration route and requirements. As these substances are also covered by DUIN holders the deferred registration deadline can also apply to these substances, but only for Letter of Access costs.
New substances (not registered in the EU prior to 1 January 2021) are subject to the full registration procedure. A dossier, an when supplied at 10 tonnes/year or more a Chemical Safety Report (risk assessment), must be submitted via the Comply with UK REACH system. Where a lead registrant is already in place, a letter of access fee must be paid to them. The evaluation fee must be paid to the UK government.
There is no deferred deadline or DUIN for these substances.
UK REACH is currently undergoing a revision in accordance with the Retained EU Law (Revocation and Reform) Act 2023.
Changes to Fee structures
A new flat registration fee of £2,222 (with reductions for SME businesses) has been announced for all tonnage bands. This represents an increase for the lowest tonnage band and around a 90% reduction for the highest tonnage band.

The UK Department for Environment, Food and Rural Affairs (Defra) is currently making changes to the UK REACH regulation and more information will be available in the coming months.
